But the land-use category still determines what you can construct on it. Land ownership and development rights are two separate legal questions, and buyers must treat them that way.
Why You Should Check Land Use Before Buying
The land use category determines your entire development plan for a plot. Residential land is classified for homes and apartments. Commercially classified land permits offices, shops, and commercial buildings. Agricultural land in Bangladesh now carries significant construction restrictions under the Land Use Control and Agricultural Land Protection Act 2026.
Mixed-use classifications allow a combination of activities. A plot that looks ideal in photos may fall inside a conservation zone, a flood-risk area, or an agricultural protection belt where construction is not permitted under current law.
How RAJUK and DAP Can Affect Land in Dhaka
RAJUK (Rajdhani Unnayan Kartripakkha) controls land use approvals, building permits, and development regulations for Dhaka and surrounding areas. RAJUK's Detailed Area Plan (DAP), revised in 2025, sets the planning guidelines and development control procedures for all land within its jurisdiction. The Dhaka Metropolitan Building Construction Regulations 2025 and the RAJUK Act 2026 set the current rules for what can be built and how it can be built.
One important point for buyers evaluating developer plots: where a private housing project already holds RAJUK approval, individual plots within that approved layout do not require a separate Land Use Clearance.
Buyers should always confirm this status directly with RAJUK. The applicable rules differ by location, Mouza, and Dag number.
What to Verify About a Plot Before You Pay
Complete all of the following checks before paying any booking deposit. Do not rely on the seller's copies alone. Verify every document independently through the relevant government office.
Original ownership deed and the full chain of title going back at least 25 years
Mutation (Namjari) certificate matching the seller's current registered name
Khatian record certified by the AC Land Office
Up-to-date land development tax payment receipts
Digital survey map and physical verification of plot boundaries on the ground
Land use category from the relevant authority (RAJUK, City Corporation, or AC Land)
RAJUK Land Use Clearance status or approved housing project authorization
Non-Encumbrance Certificate (NEC) confirming no active mortgage or legal dispute
Road access status and utility connection availability
Any development restrictions under DAP or applicable local regulations
RAJUK's Land Use Clearance process specifically requires ownership documents, a digital survey map, khatian or mutation records, and current land development tax receipts before any clearance is issued.
Can You Build What You Want on the Land
The permitted land use category determines what you can build. You cannot construct a commercial building on a residentially classified plot without first converting the land use category through a formal application to the relevant authority.
That conversion process is not automatic and is not guaranteed to be approved. Any construction also requires a separate building plan approval from RAJUK or the applicable local authority.
Land-use clearance and building plan approval are two separate requirements. Both must be satisfied before construction legally begins.
How Zoning Can Affect Land Value and Future Development
Land use classification directly affects a plot's market value and long-term development potential. Commercially classified land commands higher prices because it supports a wider range of income-generating uses.
Residentially zoned land in a growing Dhaka neighborhood offers strong appreciation potential as surrounding infrastructure improves.
Agricultural- or conservation-classified land carries development restrictions that significantly reduce its investment potential.
DAP reclassification can also change a plot's value upward or downward. Always verify the current and planned land use classification before treating any plot as a development investment.
